That Babylon of the moderns with its crystal light and its glitter. All aswarm with the wretched ruins of humanity. Men and women crushed by the Devil’s juggernaut. Moral turpitude can destroy the most delicate of lives. Believe me, I know. I know! – Mrs Gillyflower, The Crimson Horror

Things have obviously changed I remember Graham Williams was a little mystified about JNT using the Guardians without any reference to him……

You’ve given an example from a time we know it absolutely was in place. In fact given the timing it’s probably around the time people started to become aware the loophole existed.

I wouldn’t expect them to be able to do whatever they liked with them now, but you wouldn’t be very happy as a writer if someone has taken advantage of your scrpt against your will.

I want to see a Who serial about the Sontaran Rutan war with the excellent Strax taking a major role ( a trial would seem to be a good idea to me ) .

Unfortunately Big Finish are not allowed to feature the entire paternoster gang in a story together. (Source: Big Finish podcast)

I can’t remember; it was quite a few weeks ago and it was in answer to an email someone sent in. Apparently the BBC won’t let them use Vastra, Strax and Jenny together in one release. It suggests to me that Moffat still has plans for the characters in series 10 (either that or the BBC are planning a spin off). This may well change once Moffat has left, depending on what Chris Chibnall’s plans are.

They are still Moffat’s characters no matter who is in charge of the show, he’s keeping them for his “retirement”.

But The Paternoster gang were introduced in Series 6
And BF line ever goes up to Time of The Doctor
They Do Have The Rights to them then
And I believe When River Cames back for THORS they could use items and themes from that story

The character rights were retained by whoever wrote the story.

I’d expect after the fan film outpouring in the 90s they’ll be limited to certain places to use them to ensure they don’t cut all ties as others have done in the past (for example Bob Baker who has a film coming out next year with K-9 battling Omega), but there’s certainly some control (and no doubt royalties) that the writers retain.

The Licence is until The Time of the Doctor, but all Doctor Who BF stories and ideas under the Doctor Who licence have go through the Doctor Who production office at the BBC, who have the ultimate decision of whether any story or character is allowed to feature in a BF production.
Classic examples include a rejection of a Queen Victoria story in 2005-6 (which became ‘Other Lives’) around when Tooth and Claw was going to be on TV.

I heard in the podcast that the BBC rejected the idea of the three characters teaming up. This does not necessarily mean that Moffat has separated them from the licence (in theory, each character could appear individually as Strax did in Jago & Litefoot & Strax – and all three actors have recently worked for the company). It just means that a trio story has been vetoed by the production office in Cardiff.

The only reason I can think of for this is that the three characters will appear again in a future episode and the BBC are not ready to hand over the licence yet.
